These Terms of Service ("Terms") govern your use of the Apex iOS app ("Apex", "the App"), operated by We Are Omni ("we", "us", "our"). By downloading or using Apex, you agree to these Terms.
Apex is a supplement timing and nutrition tool that uses Apple HealthKit data to provide personalised recommendations. It is a wellness tool — not a medical device — and is not intended to replace professional medical advice, diagnosis, or treatment.
You must be at least 13 years old to use Apex. By using the App, you confirm that you meet this requirement. If you are under 18, you should have parental consent before using the App or subscribing to Apex Pro.
Apex offers a free tier and a paid subscription tier ("Apex Pro"):

Prices are in USD and may vary by region as displayed in the App Store.
Both plans include a 14-day free trial for new subscribers. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin and you will be billed at the applicable rate.
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Renewal charges are made through your Apple ID account.
You can view, change, or cancel your subscription at any time via: iOS Settings → [Your Name] → Subscriptions → Apex
We Are Omni does not process refunds directly. All billing is handled by Apple. Refund requests must be submitted to Apple at: reportaproblem.apple.com
The free tier includes tracking up to 3 supplements and basic manual timing, at no charge, with no time limit.

Supplement timing suggestions, nutrition targets, and readiness scores are general wellness recommendations based on publicly available research. They are not a substitute for advice from a qualified healthcare professional.

We Are Omni accepts no liability for health outcomes arising from use of Apex recommendations.
All content within Apex — including the app design, logo, supplement database, timing algorithms, and written content — is owned by We Are Omni or its licensors and is protected by copyright and intellectual property law.
You may not copy, reproduce, modify, or distribute any part of Apex without our written permission.
You agree not to:
Apex is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of bugs. We reserve the right to modify, suspend, or discontinue the App at any time.
To the fullest extent permitted by law, We Are Omni shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Apex, including but not limited to loss of data, health outcomes, or lost profits.
Our total liability for any claim arising from these Terms shall not exceed the amount you paid for Apex Pro in the 12 months preceding the claim.
We may update these Terms as the App evolves. Continued use of Apex after changes are posted constitutes your acceptance of the revised Terms. Material changes will be communicated via an in-app notice.
These Terms are governed by the laws of the State of New York, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New York County, New York.

Apple is not a party to these Terms and bears no responsibility for Apex or its content. Apple has no obligation to provide maintenance or support for Apex.
